By downloading or using Photo Ai: Image Generator (the "App"), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the App.

AI Content Notice: This App utilizes artificial intelligence algorithms to generate content. By using the App, you acknowledge that generated output may be unpredictable, and you agree to follow the safety guidelines outlined in Section 3.

1. Acceptance of Terms

By accessing and using our services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. Use of AI Services

The App uses third-party AI technologies (including pollinations.ai) to generate visual and text content. You understand that:

• You are solely responsible for the text prompts you enter and the content you generate.
• Generated content may not always be accurate, unique, or appropriate.
• The App is for creative and entertainment purposes only.

3. Prohibited Content & Guideline 1.2 Compliance

To ensure a safe environment for all users, you are strictly prohibited from using the App to generate content that is:

• Illegal, harmful, or threatening.
• Sexually explicit or NSFW (Not Safe For Work).
• Hateful, discriminatory, or promoting violence against individuals or groups.
• Infringing upon any third-party intellectual property or privacy rights.

Note: We reserve the right to permanently block any user who repeatedly attempts to generate prohibited content. Every generation includes a "Report" feature to maintain community safety.

4. Intellectual Property

Between you and Macrosoar, you own the input you provide to the App. Subject to your compliance with these terms, you may use the generated output for personal and commercial purposes, provided you do not violate any local laws or the terms of our third-party AI providers.

5. Subscriptions and Payments

The App may offer premium features via auto-renewable subscriptions. All payments are processed through the Apple App Store (iOS) or Google Play Store (Android). You are responsible for managing your subscriptions within your store account settings.

6. Limitation of Liability

Macrosoar shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App or the inability to use the App, including any output generated by the AI which may be found offensive or inaccurate.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE AI WILL PRODUCE SPECIFIC RESULTS OR THAT THE SERVICE WILL BE UNINTERRUPTED.

8. Changes to These Terms

We may update our Terms of Use from time to time. You are advised to review this page periodically for any changes. Your continued use of the App after changes are posted constitutes your acceptance of the new terms.
